Toyota Recall: Owners Not Injured and Those That Are May Have Entitlements

Toyota owners that have not been injured and those that have may be entitled to financial compensation because of the defects associated with Toyota cars. Toyota recalls have totaled approximately 8 million autos over the past several months, including several models:

  • 2009-2010 RAV4 Crossover
  • 2009-2010 Corolla
  • 2009-2010 Matrix
  • 2005-2010 Avalon Sedan
  • 2007-2010 Camry Mid Size Sedan
  • 2010 Highlander Crossover
  • 2007-2010 Tundra Pick Up
  • 2008-2010 Sequoia SUV
  • 2004- 2009 Prius
  • 2007-2010 Lexus ES350
  • 2006 – 2010 Lexus IS250 and IS350
  • 2009-2010 Venza
  • 2009-2010 Pontiac Vibe

It is important to note that not all cars are affected by the recall. Toyota car owners can call their VIN number into a Toyota dealership to identify if their car is part of the recall.  The reasons for the recall are numerous. The initial cause for concern became apparent when several accidents were reported resulting in death due to failure of the gas pedal causing undue acceleration.

Toyota cars have been linked to several defects. First, the gas pedal in some Toyota cars may stay open and prematurely wear out. Alternatively, the gas pedal may become locked in by the floor mat. These two defects can lead to the untimely increase of acceleration and pose a risk for a car accident, serious injury and death. Other complaints relate to difficulty in shifting between gears in automatic transmission vehicles.  The affected Toyota Corolla models have been linked to a steering malfunction that can lead to wavering on the road and poses a risk for a car accident, serious injury or death.  The affected Prius models have been linked to braking problems.

Toyota had advised people experiencing an inoperative gas pedal to apply the brakes with steady pressure, shift into neutral and continue braking until you stop. If the car cannot be shifted into neutral, Toyota suggested turning off the engine but keeping the key in the ignition for steering purposes.  Toyota is also available to evaluate and repair cars involved the recall at no charge.

Toyota owners that have not experienced problems may also be entitled to financial compensation because of the suspected devalue of their Toyota cars.

    Toyota lawsuits are also surfacing because Toyota cars have lost their value since the Toyota recall. With over 8 million Toyota cars affected in the recall, it is no surprise that Toyota owners have become concerned about the value of their vehicle. Select lawyers are accepting cases against Toyota for the reduced value of their vehicles.
